1. Agreement

These Terms & Conditions govern use of this website and of services provided by Fast ISP USA ("we", "us", "our"). By using this website, submitting an enquiry, or using our services, you agree to these terms. Services provided to a business customer may also be governed by a separate signed service order or agreement; where there is a conflict, the signed agreement prevails.

2. Eligibility and customer vetting

Our services are offered to businesses, not to consumers. Before service is activated, a prospective customer must complete our Know-Your-Customer onboarding, which includes identifying the legal entity and its authorised contacts, confirming the nature of the business, and describing the intended communication use case.

Customers must provide accurate and complete information, must notify us of material changes to their business or use case, and must promptly supply additional information we reasonably request to satisfy our own or a carrier's compliance requirements. We may decline or discontinue service where information cannot be verified.

3. Acceptable use

Customers may use our services only for lawful, conversational business communications — including inbound customer support, appointment scheduling and confirmation, service dispatch communication, order and delivery updates, and customer follow-up conversations.

Customers must not use our services for illegal robocalling, scam or fraudulent calling, caller ID spoofing or misrepresentation of the calling party, unlawful prerecorded-message or artificial-voice campaigns, unauthorised high-volume automated dialing, traffic pumping or artificially inflated traffic, or any attempt to bypass or manipulate carrier controls, analytics, or call labelling.

Our Acceptable Use Policy forms part of these terms. Customers are responsible for all traffic they originate and for compliance by their own personnel and any authorised users.

4. Service availability

We work to provide reliable service but do not warrant uninterrupted or error-free operation. Service may be affected by maintenance, upstream carrier conditions, network events, or circumstances beyond our reasonable control. Where a service level commitment applies, it is stated in the customer's signed service order.

We may perform planned maintenance and will use reasonable efforts to schedule it to minimise disruption. Emergency maintenance may be performed without advance notice.

5. Payment terms

Charges, rates, and payment intervals are set out in the customer's service order or rate schedule. Invoices are payable in U.S. dollars within the period stated on the invoice. Undisputed amounts not paid when due may accrue interest at the rate permitted by law and may result in suspension of service after notice.

Disputed charges should be raised in writing within the period stated in the applicable service order, together with sufficient detail for us to investigate. Taxes, regulatory fees, and surcharges applicable to the services are the customer's responsibility unless stated otherwise.

6. Suspension and termination

We may suspend or terminate service, in whole or in part, immediately and without liability where we reasonably believe a customer has breached our Acceptable Use Policy, where traffic presents a legal, regulatory, or network-integrity risk, where an upstream carrier or regulator requires it, or where amounts remain unpaid after notice.

Either party may terminate for material breach that is not cured within a reasonable notice period, and otherwise in accordance with the customer's service order. On termination, the customer remains liable for charges incurred up to the termination date.

7. Numbers and assignments

Telephone numbers assigned to a customer are provided for use by that customer's business and remain subject to applicable numbering rules and carrier requirements. Customers obtain no ownership right in assigned numbers except as provided by law, and numbers may be reclaimed following termination or where required for regulatory or compliance reasons.

8. Confidentiality

Each party will protect the other's non-public business information disclosed in connection with the services, use it only for purposes of the relationship, and disclose it only to personnel and advisers who need it. This does not restrict disclosure required by law or by a regulator or carrier acting within its authority.

9. Intellectual property

The Fast ISP USA name, tagline, logo, website content, and service documentation are our property and may not be copied, reproduced, or used without our written permission.

10. Disclaimers

Except as expressly stated in a signed agreement, services are provided on an "as is" and "as available" basis, and we disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Content on this website is provided for general information and does not constitute a binding offer.

11. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business, or loss of data, arising out of or relating to the services, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the services is limited to the amounts paid by the customer for the affected service in the three months preceding the event giving rise to the claim.

12. Indemnity

Customers will indemnify and hold us harmless against claims, penalties, losses, and reasonable costs arising from their use of the services in breach of these terms or our Acceptable Use Policy, or from traffic they originate that violates applicable law or regulation.

13. Governing law

These terms are governed by the laws of the United States and of the state in which we are organised, without regard to conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the competent courts located in that state for disputes not resolved informally.

14. Changes to these terms

We may update these terms to reflect changes in our services or in legal and regulatory requirements. The version published on this page is the current version, and continued use of the website or services constitutes acceptance of it.
